Appeal Court Can’t Stay A Criminal Case – Appeal Court To Onnoghen

PoliticsNGR has gotten more details on the rejection of a motion filed by the suspended Chief Justice of Nigeria, Walter Onnoghen by the court of Appeal.

It was gathered that the Court of Appeal in Abuja
rejected the request of Onnoghen to stay proceedings in the charge
pending against him before the Code of Conduct Tribunal (CCT).

A three-man panel, led by Justice Abdul Aboki, in a ruling, dismissed the application Onnoghen filed to that effect.

The
court said, in view of the provision of Section 306 of the
Administration of Criminal Justice Act (ACJA), it lacked the power to
stay proceedings in criminal cases.
