Following Spain’s victory over England in the Women’s World Cup final, Rubiales planted a kiss on Jenni Hermoso’s lips and resigned from his position in September.
Hermoso claimed the kiss was not consensual and went on to initiate a lawsuit against Rubiales.
The Court of Arbitration for Sport may hear challenges to the ruling.
A Spanish court suggested on Thursday that Rubiales be put on trial in relation to the event, characterizing the kiss as “not consensual and… a unilateral and surprising initiative”.
Mr. Rubiales was previously accused by prosecutors of coercion and sexual abuse.
Rubiales has always insisted that the kiss was a “consensual peck,” yet he was compelled to step down as the president of the Spanish Football Federation (RFEF) following the event.
It sparked a global outcry against sexism at the pinnacles of women’s sports.
“Amongst other considerations, the appeal committee was comfortably satisfied that Mr Rubiales behaved in a manner contrary to the principles enshrined under article 13 of the Fifa disciplinary code during and after the final of the Fifa Women’s World Cup,” said a statement issued by world football’s governing body.
Fair play principles and offensive behavior are covered in Article 13 of the FIFA disciplinary rule.

As part of the criminal case against Rubiales, Jorge Vilda, the manager who won the World Cup, was fired in September and is currently under investigation.
